By requesting, scheduling, or accepting services from Mitigation Response (“we,” “us,” or “our”), you (“client,” “you,” or “your”) agree to be bound by these Terms of Service.
2. Scope of Services
We provide restoration services including, but not limited to:
- Water damage mitigation
- Fire and smoke damage restoration
- Mold remediation
- Storm and disaster cleanup
- Structural drying and repairs
Each service will be performed as described in the project estimate or service agreement.
3. Estimates and Payment Terms
- All estimates are provided based on an initial assessment and may be subject to change.
- Final costs may vary based on actual labor, materials, and scope changes.
- A signed estimate or work authorization form is required before services begin.
- Payment is due upon completion of services unless otherwise agreed in writing.
4. Insurance Claims
If services are covered by insurance:
- We will help you coordinate with your insurance company
- We will assist in documentation but are not responsible for claim outcomes.
- You remain financially responsible for any amount not covered by insurance.
5. Customer Responsibilities
You agree to:
- Provide safe and reasonable access to the property.
- Disclose known hazards (e.g., asbestos, lead paint, biohazards).
- Remove valuables or sensitive materials prior to work commencing.
- Cooperate with all reasonable requests related to safety and service performance.
6. Limitations of Liability
- We are not liable for pre-existing damage or conditions unrelated to our services.
- We are not responsible for delays caused by weather, supplier shortages, or circumstances beyond our control.
- Any liability for damages arising from our services is limited to the amount paid for those services.
7. Warranties
We may offer a limited workmanship warranty on completed services. Warranty details will be provided in writing and do not cover:
- Damage caused by future events (e.g., new water intrusion, fires, storms)
- Improper maintenance or third-party alterations
- Hidden conditions or pre-existing structural issues
8. Termination
Either party may terminate the service agreement at any time, subject to:
- Payment for work completed to date
- Return of equipment or materials provided
- Reasonable notice unless immediate termination is necessary due to safety or legal reasons
9. Governing Law
These Terms are governed by the laws of the State of [Your State], without regard to its conflict of laws rules.
10. Dispute Resolution
Disputes will be handled through:
- Initial good-faith negotiation
- If unresolved, binding arbitration in Hayden, Idaho, unless otherwise required by law
